Corporate Asset Recovery
Our team consists of lawyers and paralegals who devote almost all of their time to the recovery of deficiency commercial claims for banks and financial institutions based on a contingency recovery model. We depend on our ability to deliver creative, aggressive, and highly professional legal services. As a law firm substantially devoted to the enforcement and protection of creditors rights, we have the ability to quickly and easily move from state court, federal court, bankruptcy court and workout mode. We do not use “collectors” at any stage of our representation.

It is a commonly accepted view in the banking and financial services industry that the pursuit of a deficiency claim against a guarantor is often futile or not worth the cost. While this view can be well-founded, we analyze each case on an individual basis and determine whether the resources of our law firm should be deployed on a claim that will bring no fee unless we are successful. We are unlike any collection agency or law firm that handles collection matters with a large pool of collectors. Our approach to commercial collections is attorney-driven. Creditors’ Rights & Bankruptcy
The scope of our bankruptcy practice includes the representation of creditors in bankruptcy proceedings under all Chapters of the Bankruptcy Code. We have litigated against debtors, debtors-in-possession, other creditors, committees, other secured creditors, landlords, plan of reorganization proponents, parties to acquisition agreements, and special interests. We have regularly litigated contested matters and adversary proceedings in Chapter 11 cases, as well as Chapter 7 liquidations.

Our clients rely upon us to protect their rights as secured or unsecured creditors. We regularly represent secured and unsecured creditors, creditors’ committees and bankruptcy trustees in cases under Chapters 7, 11, and 13 and the entire range of bankruptcy litigation. Our practice also includes extensive representation in loan workouts, debt restructuring, dispositions of assets and refinancing.
